Our father died last Dec 2010. We are going to claim burial benefits and the sss office told us that it is claimed already. We are legitimate/legal claimants of our father as it listed on his sss form. We didn't claim any as far as we knew. The question here is, How it is happened? Is this just a strategy of the said office where as claimants never do to pursue claiming because we will spend time, money and effort of submitting papers more than what we will claim? Why they doing this? What is sss membership for?

mag inquire k sss office kung sinong nag claim, kaya nila etrace yan, ako nga nagclaim n pero may pinapirma p n waiver, kaya may right k kung ikaw talaga ang legitimate....o baka nakuha n ng other members ng family mo...

The rightful claimants of the SSS benefits of the deceased member should be the beneficiary as per declared by the member. In the case where not the beneficiary/beneficiaries had claimed the benefits it is again a fishy transaction of the local branch office.

The best thing to do is go back to the SSS branch office and find out the details of the claimant. Should you have applied for a claim, Other considerations could be maybe the check is already in transit through snail mail and have not yet reached your address.
