Hi, good morning..

I have a problem.. few days before my interview with the employer, the agencyB ask me if I'm interested to work in Singapore and if I am willing to leave immediately. and I said yes.. I have asked them whats the job description and the company, and they only said the company's name, the job title and salary.

So I waited for the interview date and time to try my luck. (FYI: I also had been interviewed by another employer with another agencyA, not knowing if I had passed the interview, that's why I said yes!)
When the date comes, the agency gave me brief introduction about the company and the processing fee guidelines. After the interview with the employer and got home, my other agency(agencyA) texted me that I had passed the interview with their employer. So I had to choose and think what I liked best without reading both of the contract of different company. The night after, I texted agencyB to cancel my application with the reason of family problems. I can;t think of any other reason, and Im afraid if Ive told them that I will be choosing agencyA, they might do something bad.

So I choose the first employer and agencyA. The next day I got off my bed and got excited to go to agencyA's office for contract discussion/signing. And when arrived from their office, they told me that I already have an approved visa, so I guessed it's with agencyB. I don't understand why they applied me visa minutes after the interview. Even without contract signing. I already asked them many times to cancel my application and even sent them letter of cancellation.

Until now, for 2 weeks they keep me on-hold and not answering my texts and calls..

Do you have suggestions on how i can deal with this?

Thank you very much!

Are you sure that your visa application is with agency B?

Hmm, :rollL don't know how did you get that visa like the speed of light... anyway, since you are still not totally committed to Agency B, hindi ka nga nila dapat ni-request at inissuehan ng visa... it is their fault - not yours... unfortunately, magsu-suffer ka din... dahil nga sa, if your destination is the same country, until na ma-cancel 'yung naunang visa, hindi ka definitely maissuehan ng panibagong visa...

Honestly, I was also wondering kung bakit hindi pa immediately i-cancel ng Agency B 'yung visa mo para magamit nila sa iba... kasi, habang naka-attach sa 'yo 'yung visa, hindi nila ito pupuwedeng ipagamit sa iba... and definitely, hindi sila makakapagpaalis ng tao as your replacement... very strange sa isang agency 'yung hindi i-grab 'yung opportunity na kumita... feeling ko tuloy, para kang bida sa isang teleserye na wala nang inatupag 'yung kontrabida kungdi ang pahirapan ang buhay ng bida... :shifty:

Going back to the reality, if you can contact 'yung employer sa Agency B, better to ask them directly na ipa-cancel na 'yung inissue sa 'yong visa... tell them na hindi ka na tutuloy dahil sa family matters at maghihintay lang sila sa wala kung hindi ipapa-cancel 'yung visa mo para magamit sa iba... other than directly asking the employer to cancel the visa, I guess, you have no other alternative but to wait for the next kabanata wherein there will be another supporting bida actor or actress from the agency who will convince those evils to let you go - but ofcourse with still unending evil plans...

Btw, mayroon din naman expiration 'yung issuance ng visa... not sure where you are going, but in Middle East, kapag entry visa ang inissue, kailangang makaalis 'yung aplikante ng within 3 months or otherwise, mapapaso 'yung visa... although at that time, very unlikely na maghintay pa sa 'yo 'yung employer ng Agency A...

A lot of applicants nowadays are getting duped by the recruiters... just to keep them informed as to what to do in case it will happen to them.

Dami na pala bago dito sa forum ah... it has been ages already

Parang pag nagback out ako may babayaran pa din parang 10k hays leche.

2. Matatapos kaya ang data flow ng May 9 and 10? Tapos tsaka ko nalang bayaran yung agency?
Estimates?
4. Useful or useless po ba yung dataflow na natapos ng i.kon kung sakali lumipat ako sa abba?
6. Tumatanggap ba ang abba or other agency ng nagback out na applicant sa iba na tapos na sa data flow?

Hays. Compared sa Tawam na 6,000 aed free house and food. Yearly paid leave and yearly paid airline ticket =)
Now what are the things that I should do and accomplish? Please help. Thanks po.

Again, puwede kayong mag-backout anytime... it is your right... at mas maganda na sa Pilipinas pa lang ay mag-backout na kayo kaysa naman doon pa kayo mag-backout - mas complikado na ang situasyon... 'yun nga lang, siyempre, depende na sa processing stage 'nung time na nag-backout kayo... the cost of withdrawing your application is totally depend on what processing stage you are right now when you formally decided to backout... i.e. mas maaga ang pag-bcakout ninyo, mas less ang damage cost (kung hindi man totally wala)... mas matagal kayong nag-isip at nagmuni-muni, mas malaki na ang babayaran ninyo... at ang mga dapat lang naman ninyong bayaran ay 'yung mga proseso na kungdi ang agency ang nagbayad ay 'yung mismong employer gaya halimbawa kung ang nagbayad ng processing ng dataflow ninyo ay ang employer, you have to pay that... and you can verify this during your discussion with the agency...

Mga Sir and Ma'am,

I've withdrawn na kasi yung processing ng papers ko for a job in jeddah, and as usual medyu nanindak ang agency.

Gustu ko na kasi matapos to once and for all, iba kasi yung may peace of mind ka. Sana makapagpasa ng law regarding yung maximum time na pwede lang hawakan ng agency yung documents upon notice of withdrawal.

Tulung naman po dito, Salamat!

I've mentioned this so many times, but I will still mention this... there is a Republic Act No. 10022... an act amending R.A. 8042, or otherwise knows as The Migrant Workers & Overseas Filipinos Act of 1995... under Sec. 6-(k), nakasaad po doon na ang isa sa mga grounds ng illegal recruitment i.e. "To withhold or deny travel documents from applicant workers before departure for monetary or financial considerations, or for any other reasons, other than those authorized under the Labor Code and its implementing rules and regulations"... puwede mo itong gamiting basehan para makuha mo 'yung mga dokumento lalo na 'yung passport mo dahil sa may batas din tayo regarding sa ownership ng passport (Republic Act No. 8239 - The Philippine Passport Act of 1996)...

I shared this before and I will share it again... I have a cousin na nasa ganoong situsayon din before... he got another better offer, so he withdraw his application from the first agency - only that, he was required to pay a fine (withdrawal fee)... the agency is asking PhP30K... my cousin is willing to pay PhP20K... pero nagmatigas 'yung agency... so, they both file complaint to POEA... his original documents & passport were given to him immediately dahil nga sa hindi ito pupuwedeng gawing collateral ng agency para puwersahin s'yang magbayad ng withdrawal fee... it is totally against the RA No. 10022 (as I mentioned above)... and their case was discussed as separate issues... in the end, walang binayarang danyos puwerhisyo (damaged fee) 'yung pinsan ko dahil sa wala pa palang approved JO 'yung agency para sa kanya... 'yun nga lang, inabot s'ya ng mahigit 8 buwan na hindi na din nakapaghintay 'yung bagong employer...

Again, you can use that RA 10022 para puwersahang makuha 'yung mga dokumento mo... and I'm sure, all agencies are aware of this republic act... they might open a discussion for you kapag sinabi mo sa kanila 'yung karapatan mo sa iyong mga dokumento...

dude, kulitin mo na sila...nang-iistall lang yan para pag tumagal hindi mo na makuha yung offer mo sa ibang agency...hindi totoo yung sinasabi nila ipapaalam pa sa boss, malamang sa malamang hindi pa nila pinapaalam yan dahil: takot sila mapagalitan, or gustu lang nila magiba isip mo at tumuluy sa kanila...remember, isang araw lang ang magpaalam sa boss nila at isang araw lang din ang magpacancel ng visa...so it doesnt add up kung halos mag 2 weeks wala pa din silang feedback from them; kung gayon ay derecho ka na sa POEA to file a complaint...

walang silang karapatan na e-hold ang travel documents mo remember that...kung may fees ka man na babayaran, ibalik muna nila yung docs mo at huwag itong gawing collateral...ang malala kasi nyan baka hinohostage nila yung docs mo for "monetary/financial" considerations... know your rights!
